Terms of Service & EULA

By downloading, installing, registering, accessing, or utilizing any mobile application, digital utility, SDK, or online service published by Sky Touch Media (STMLabs), you represent and warrant that you have read, understood, and agreed to be unreservedly bound by these Terms of Service and End User License Agreement ("Terms").

This agreement encompasses all application versions, future updates, supplemental plugins, in-app digital purchases, auto-renewing subscriptions, and web endpoints operated under our entity.

We are committed to the safety of younger audiences and strict compliance with the Children's Online Privacy Protection Act (COPPA), European Union GDPR-K, and Section 9 of the India Digital Personal Data Protection Act, 2023 (DPDP Act 2023):

• Minimum Age Requirement (13+): You must be at least 13 years of age (or 16 years of age in applicable European Union jurisdictions) to download, install, or use any application published by Sky Touch Media.
• Parental or Legal Guardian Consent for Minors (Under 18): If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you represent and warrant that your parent or legal guardian has reviewed, accepted, and consented to these Terms on your behalf prior to your use of the application.
• Contractual Capacity: By using our services, you affirm that you have full legal capacity to enter into a binding contract under the Indian Contract Act, 1872, or have received verifiable parental authorization. If we discover that a user under 13 has accessed our apps without verified parental consent, we will promptly revoke access and purge any associated telemetry.

Certain features, premium tools, sound packs, export formats, or ad-free tiers may require the purchase of a digital license or an auto-renewing subscription. The following billing terms apply unconditionally:

Free application tiers are subsidized through digital advertising provided by vetted advertising networks (e.g. Google AdMob). Advertisements are integral to maintaining, hosting, and updating free software utilities.

All software, compiled binaries, APK/AAB packages, iOS ipa files, source code, visual design elements, user interfaces, branding assets, custom sound tracks, logos, and proprietary algorithms belong exclusively to Sky Touch Media (STMLabs) and are protected under Indian and international copyright, trademark, and trade secret treaties.

Where our applications enable you to generate, store, or process content (such as compressed photos, grocery lists, custom audio mixes, documents, or plant care logs):

• Ownership of User Content: You retain full copyright and ownership of your photos, documents, and private data. We do not claim proprietary rights over your locally processed content.
• Lawful Conduct: You agree not to use our applications to process, generate, or distribute any content that is illegal, defamatory, obscene, infringing upon third-party intellectual property, or containing malicious code or spyware.
• Local Storage Responsibility: Since most of our utilities (such as PixShrink, ZenFocus, PlantDoc, Ration Suchi) operate on a local-first SQLite architecture, you are solely responsible for maintaining backups of your files and device storage.

In strict compliance with Google Play Store 2026 Data Deletion Policy and the India DPDP Act 2023, you hold an absolute statutory right to delete your data or revoke app permissions at any time:

While we engineer our software for high reliability and mathematical precision, calculations (such as loan interest rates, financial forecasts, photo dimension compression, or botanical care suggestions) are provided strictly for informational and domestic utility purposes. Users must independently verify critical financial, legal, agricultural, or medical figures.

To the maximum extent permitted by applicable Indian law, Sky Touch Media (STMLabs), its founders, partners, employees, and software engineers shall not be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages (including, without limitation, loss of profits, loss of data, hardware damage, battery wear, business interruption, or financial reliance loss) arising from the use or inability to use our applications, device OS background optimization/killing, or hardware defects.

Sky Touch Media shall not be held liable or responsible for any failure, delay, or disruption in the performance of our obligations, in-app services, or cloud synchronization resulting directly or indirectly from acts, events, or omissions beyond our reasonable control ("Force Majeure Event").

Force Majeure Events include, without limitation: acts of God, floods, fires, earthquakes, epidemics, pandemics, wars, civil unrest, government embargoes or statutory orders, utility power failures, regional telecommunications outages, global internet disruptions, major cloud provider server outages (e.g. AWS, Google Cloud, Cloudflare, Vercel), or severe third-party API rate limits.

These Terms of Service, their validity, construction, performance, and all disputes arising out of or related to our mobile applications or digital platforms shall be governed by, interpreted, and construed in accordance with the substantive laws of India, without giving effect to any principles of conflicts of law.

Severability: If any provision, clause, or term of these Terms is determined by a court or arbitral tribunal of competent jurisdiction to be invalid, illegal, void, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of these Terms shall remain in full force and effect without impairment.

Non-Waiver: No failure or delay by Sky Touch Media in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy preclude any further exercise thereof or the exercise of any other statutory right.

Assignment by Sky Touch Media: Sky Touch Media reserves the right to assign, delegate, subcontract, or transfer any or all of its rights, titles, and obligations under these Terms, in whole or in part, without restriction or notice, in connection with a merger, acquisition, corporate restructuring, sale of assets, or operation of law.

No Assignment by User: You may not assign, sublicense, pledge, or transfer any of your rights or obligations under these Terms to any other person or entity without the prior written express consent of Sky Touch Media. Any unauthorized assignment shall be void ab initio.

We reserve the right, at our sole discretion, to modify, update, amend, or replace these Terms of Service periodically to reflect changes in our applications, platform security requirements, Google Play or Apple App Store policies, or statutory enactments.

• Notification Mechanism: When we make updates, we will update the "Last Revised" date at the top of this document. For material amendments that substantially alter user rights, we will provide conspicuous notice through an in-app dialog notice, push alert, or prominent banner on our official website (stmlabs.net).
• Continued Acceptance: Your continued download, installation, retention, or use of any Sky Touch Media application following the effective date of updated Terms constitutes your binding and affirmative acceptance of the revised Terms. If you disagree with any modification, your sole recourse is to discontinue use and uninstall the application.
